Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FieldOp application and website (the "Service") provided by Allow Me Solutions Pty Ltd ("we", "us", "our"). By using the Service, you agree to be bound by these Terms.

1. Eligibility and account

You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. You must notify us immediately of any unauthorised use.

2. Acceptable use

You agree not to:

  • Use the Service in violation of any law.
  • Interfere with or disrupt the Service.
  • Attempt to gain unauthorised access to any part of the Service.
  • Reverse engineer, decompile, or attempt to extract source code.
  • Use the Service to send spam or unsolicited communications.
  • Upload content you do not have rights to use.

3. Your content

You retain ownership of any data you input into the Service ("Your Content"). You grant us a licence to host, store, process, and display Your Content solely to operate the Service for you. You represent that you have the necessary rights to Your Content and that it does not violate any law or third-party rights.

4. Subscriptions and payment

If the Service requires a subscription, you agree to pay the applicable fees. Fees are charged in advance and are non-refundable except as required by law. We may change pricing on 30 days' notice.

5. Service availability

We aim to provide the Service with high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue parts of the Service at any time, with reasonable notice where practical.

6. Third-party services

The Service integrates with third-party services (e.g. Supabase, Apple Push Notifications, Twilio). Use of those services is subject to their own terms.

7. Termination

You may terminate your account at any time. We may suspend or terminate your access for breach of these Terms or for any conduct we believe is harmful to other users or the Service. On termination, your right to use the Service ends; we may delete your data after a reasonable period unless required to retain it by law.

8. Disclaimers

The Service is provided "as is" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service is limited to the fees you paid us in the 12 months preceding the claim, or AUD 100, whichever is greater.

Nothing in these Terms limits any rights you have under the Australian Consumer Law that cannot be lawfully excluded.

10. Governing law

These Terms are governed by the laws of Victoria, Australia. Disputes will be resolved in the courts of Victoria.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified via email or in-app notice. Continued use after changes constitutes acceptance.
